1. Acceptance of Terms

Welcome to Pixaroo. These Terms of Service ("Terms") govern your use of the Pixaroo iOS mobile application (the "App") operated by Pixaroo ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Pixaroo is a mobile photography application that allows users to:

  • Capture photos using both front and back cameras simultaneously
  • Apply Instax-style frames and vintage filters to photos
  • Create dual-camera compositions with picture-in-picture effects
  • Save and share photos to various social media platforms
  • Access premium features through in-app purchases

3. Eligibility

If you are under 18 years old, you must have parental or guardian consent to use the App and make any in-app purchases. Parents and guardians are responsible for supervising their children's use of the App and any associated purchases. By using the App, you represent and warrant that you meet these requirements.

4. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your iOS device for personal, non-commercial purposes. This license does not include the right to:

  • Reverse engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works based on the App
  • Distribute, sell, or sublicense the App
  • Remove or alter any proprietary notices or labels

5. In-App Purchases and Subscriptions

5.1 Premium Features

Pixaroo may offer premium features, content, or subscriptions for purchase through the App Store's in-app purchase system. These may include:

  • Additional filters and effects
  • Advanced editing tools
  • Premium Instax frame designs
  • Ad-free experience
  • Cloud storage features

5.2 Payment and Billing

  • All purchases are processed through Apple's App Store
  • Prices are displayed in your local currency
  • Payment will be charged to your Apple ID account
  • For subscriptions, payment will be charged automatically unless auto-renewal is turned off at least 24 hours before the current period ends

5.3 Subscription Management

  • Subscriptions automatically renew unless cancelled
  • You can manage and cancel subscriptions through your Apple ID account settings
  • Cancellation takes effect after the current billing period ends
  • No refunds for unused portions of subscriptions

5.4 Refunds

All sales are final. Refund requests must be made directly through Apple's App Store refund system. We do not process refunds directly.

6. User Content and Privacy

6.1 Your Photos

You retain all rights to photos you create using the App. We do not claim ownership of your photos. However, by using the App, you grant us a limited license to:

  • Process your photos locally on your device to provide App functionality
  • Display your photos within the App interface

6.2 Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Acceptable Use

You agree not to use the App to:

  • Create, store, or share content that is illegal, harmful, offensive, or violates third-party rights
  • Engage in any activity that could harm, disable, or impair the App's functionality
  • Attempt to gain unauthorized access to the App or related systems
  • Use the App for commercial purposes without our written consent
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload or share content containing malware or viruses

8. Intellectual Property

The App and its contents, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

9. Third-Party Services

The App may integrate with or provide access to third-party services, including:

  • Social media platforms for photo sharing
  • Analytics and crash reporting services

Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for any third-party services.

10. App Store Terms

Your use of the App is also subject to Apple's App Store Terms and Conditions. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App Store.

11. Updates and Modifications

We may update the App from time to time to:

  • Add new features or improve existing ones
  • Fix bugs or security issues
  • Ensure compatibility with newer iOS versions
  • Comply with legal requirements

Updates may be required to continue using the App. We may also modify these Terms at any time by posting updated Terms on our website.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination:

  • Your license to use the App immediately ends
  • You must delete the App from your devices
  • Any outstanding subscription fees are non-refundable
  • Provisions that should survive termination will remain in effect

13. Disclaimers and Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • ACCURACY OR RELIABILITY OF INFORMATION

We do not guarantee that the App will meet your requirements or be available at all times.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, or use
  • Business interruption
  • Personal injury or property damage
  • Loss of privacy

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you create or share using the App

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and understandings.

19. Apple-Specific Terms

For users who download the App from the Apple App Store, the following additional terms apply:

  • Apple is not a party to these Terms and has no responsibility for the App or its content
  • Apple has no obligation to provide maintenance or support for the App
  • In case of App failure to conform to warranties, you may notify Apple for a refund, and Apple will have no other warranty obligation
  • Apple is not responsible for addressing any claims relating to the App
  • Apple and its subsidiaries are third-party beneficiaries of these Terms
